CNPD - Intragroup Agreement for International Data Transfer

Article written by Monica Oliveira Costa from PLG's member firm CRA Law in Lisbon on the Portuguese DPA Decision of November 10, explicitly stating that Intragroup Agreements used for the transfer of personal data to a third country are appropriate contractual clauses as long as their clauses are identical and compliant with the Standard Contractual Clauses (Model Clauses) approved by the European Commission.
However and regrettably, Binding Corporate Rules (BCRs) are still not recognised by the CNPD as a legitimate ground for international data transfers.
